AGENCY: Bureau of Land Management, Interior.
ACTION: Notice.
SUMMARY: This notice terminates a Recreation and Public Purposes Classification and provides for opening the affected lands to appropriation under the public land laws and the general mining laws.
EFFECTIVE DATE: July 2, 1998.

SUPPLEMENTARY INFORMATION: A proposed sanitary landfill site was classified for lease by Initial Classification Decision dated February 22, 1977. The land was classified for lease under the Act of June 14, 1926 (44 Stat. 741), as amended by the Act of June 4, 1954 (68 Stat. 173, 43 U.S.C. 869, Sections 1-4),
The subject lands were leased for a term of 20 years, on December 19, 1977, to the Board of Washoe County Commissioners for a sanitary landfill. The landfill was closed due to Environmental Protection Agency regulations and a transfer station was opened at an alternate site. The landfill was closed prior to the lease expiration date and the lease was allowed to expire within its term.
Pursuant to Section 7 of the Taylor Grazing Act (48 Stat. 1272), the aforementioned Recreation and Public Purposes classification is hereby terminated as it affects the following described land:
Mount Diablo Meridian, Nevada
T. 32 N., R. 23 E.,
Sec. 17; NE\1/4\SE\1/4\SW\1/4\, NW\1/4\SE\1/4\, N\1/2\SW\1/ 4\SE\1/4\.
The area described contains 70 acres.
At 9:00 a.m. on July 2, 1998 the above described 70 acres will become open to the operation of the public land laws, subject to valid existing rights, the provisions of existing withdrawals, other segregations of record, and the requirements of applicable laws, rules, and regulations.
At 9:00 a.m. on July 2, 1998 the 70 acres will become open to location under the United States mining laws. Appropriation of the land under the general mining laws prior to the date and time of restoration is unauthorized. Any such attempted appropriation, including attempted adverse possession under 30 U.S.C. 38, shall vest no rights against the United States. Acts required to establish a location and to initiate a right of possession are governed by State law where not in conflict with Federal law. The Bureau of Land Management will not intervene in disputes between rival locators over possessory rights since Congress has provided for such determinations in local courts.
