AGENCY: Federal Communications Commission.

ACTION: Proposed rule.

SUMMARY: The Commission requests comments on a petition filedby Davis Television Clarksburg, LLC, licensee of station WVFX(TV), NTSC Channel 46, Clarksburg, West Virginia, requesting the substitution of DTV Channel 10 for its assigned DTV Channel 28. DTV Channel 10 can be allotted to Clarksburg, West Virginia, in compliance with the principle community coverage requirements of Section 73.625(a) at coordinates 39- 18-02 N. and 80-20-37 W. DTV Channel 10 can be allotted Clarksburg with a power of 30 kW and a height above average terrain (HAAT) 260 meters. Since the community of Clarksburg is located within 400 kilometers of the U.S.-Canadian border, concurrence by the Canadian government must be obtained for this allotment.

Provisions of the Regulatory Flexibility Act of 1980 do not apply to this proceeding.

  2. Section 73.622(b), the Table of Digital Television Allotments under West Virginia is amended by removing DTV Channel 28 and adding DTV Channel 10 at Clarksburg.
