Approval and Promulgation of Implementation Plans Alabama:
Volatile Organic Compounds
AGENCY: Environmental Protection Agency (EPA).
ACTION: Proposed rule.
SUMMARY: EPA is proposing to approve a revision to the Alabama State
Implementation Plan (SIP) submitted by the Alabama Department of
Environmental Management (ADEM) on March 3, 2010. The proposed revision would modify the definition of ``volatile organic compounds'' (VOCs) found at Alabama Administrative Code section 335-3-1-.02(gggg).
Specifically, the revision would add two compounds (propylene carbonate and dimethyl carbonate) to the list of those excluded from the VOC definition on the basis that these compounds make a negligible contribution to tropospheric ozone formation. ADEM is seeking to update its SIP to be consistent with the federal rule finalized by EPA on
January 21, 2009, which excludes these compounds from the regulatory definition of VOC. This action is being taken pursuant to Section 110 of the Clean Air Act.

SUPPLEMENTARY INFORMATION: For additional information see the direct final rule which is published in the Rules Section of this Federal
Register. In the Final Rules Section of this Federal Register, EPA is approving the State's SIP revision as a direct final rule without prior proposal because the Agency views this as a noncontroversial submittal and anticipates no adverse comments. A detailed rationale for the approval is set forth in the direct final rule. If EPA receives no adverse comments in response to this notice, no further activity is contemplated. If EPA receives adverse comments, EPA will withdraw the direct final rule and will address all public comments received in a subsequent final rule based on this proposed rule. EPA will not institute a second comment period on this document. Any parties interested in commenting on this document should do so at this time.
