AGENCY: Federal Communications Commission.

ACTION: Proposed rule.

SUMMARY: This document requests comments on a petition for rule making filedon behalf of L. Topaz Enterprises, Inc., requesting the allotment of Channel 240A to Wellton, Arizona, as that community's second local FM transmission service. As Wellton is located within 320 kilometers (199 miles) of the U.S.-Mexico border, concurrence of the Mexican government to the proposed allotment of Channel 240A to that community will be required. Coordinates used for this proposal are 32-40-18 NL; 114-08-18.

DATES: Comments must be filedon or before May 24, 1999, and reply comments on or before June 8, 1999.

Provisions of the Regulatory Flexibility Act of l980 do not apply to this proceeding.
