A.

(1) The Department may inspect or investigate
the practices of any person involved in lead-based paint activities in target
housing or child-occupied facilities as defined in these rules.

(2) Advance notice of inspections or
investigations by the Department is not required.

(3) Department representatives shall not be
impeded or refused entry in the course of their official duties in accordance
with these regulations by reason of any regulatory or contractual
specification.

(4) All persons
engaged in lead-based paint activities must have the Commission-issued
certificate or required training records present at the worksite.
B.
- Penalties, reprimands, suspensions and revocations of
certificates shall be governed by Section
Mississippi Code Annotated. All proceedings and hearings before the Commission
regarding violations of Section
49-17-529
et seq. Mississippi Code Annotated, or any rule or regulation, written order of
the Commission, emergency order of the Executive Director or certificates
issued or renewed by the Commission pursuant to Section
49-17-501
et seq., Mississippi Code Annotated and all appeals therefrom shall be
conducted in accordance with Section
49-17-501
through
49-17-31
