Privacy Act
DOT solicits comments from the
public to better inform its regulatory
processes, in accordance with statute 49
U.S.C. 31315(b)(6)(A). DOT posts these
comments, without edit, including any
personal information the commenter
provides, to www.regulations.gov, as
described in the system of records
notice (DOT/ALL 14—Federal Docket
Management System), which can be
reviewed at www.transportation.gov/
privacy.
II. Legal Basis
FMCSA has authority under 49 U.S.C.
31315(b) to grant exemptions from
certain parts of the Federal Motor
Carrier Safety Regulations (FMCSRs).
FMCSA must publish a notice of each
exemption request in the Federal
Register (49 CFR 381.315(a)). The
Agency must provide the public an
opportunity to inspect the information
relevant to the application, including
any safety analyses that have been
conducted. The Agency must also
provide an opportunity for public
comment on the request. The Agency
reviews the safety analyses and the
public comments and determines
whether granting the exemption would
likely achieve a level of safety
equivalent to or greater than the level
that would be achieved by the current
regulation (49 CFR 381.305). The
decision of the Agency must be
published in the Federal Register (49
CFR 381.315(b)). If the Agency denies
the request, it must state the reason for
doing so. If the decision is to grant the
exemption, the notice must specify the
person or class of persons receiving the
exemption and the regulatory provision
or provisions from which an exemption
is granted. The notice must specify the
effective period of the exemption (up to
5 years) and explain the terms and
conditions of the exemption. The
exemption may be renewed (49 CFR
381.315(c) and 49 CFR 381.300(b)).
KeepTruckin’s Application for
Exemption
The FMCSRs require devices meeting
the definition of ‘‘vehicle safety
technology’’ to be mounted (1) not more
than 4 inches below the upper edge of
the area swept by the windshield
wipers, or (2) not more than 7 inches
above the lower edge of the area swept
by the windshield wipers, and outside
the driver’s sight lines to the road and
highway signs and signals. KeepTruckin
has applied for an exemption from 49
CFR 393.60(e)(1) to allow its AI
Dashcam system, which is equipped
with camera(s) and safety technologies,
to be mounted lower in the windshield
than is currently permitted. A copy of
the exemption application is included
in the docket referenced at the
beginning of this notice.
Request for Comments
In accordance with 49 U.S.C.
31315(b)(6), FMCSA requests public
comment from all interested persons on
KeepTruckin’s application for an
exemption. All comments received
before the close of business on the
comment closing date indicated at the
beginning of this notice will be
considered and will be available for
examination in the docket at the
location listed under the
ADDRESSES
section of this notice. Comments
received after the comment closing date
will be filed in the public docket and
will be considered to the extent
practicable. In addition to late
comments, FMCSA will also continue to
file, in the public docket, relevant
information that becomes available after
the comment closing date. Interested
persons should continue to examine the
public docket for new material.

Needs and Uses: Program uses for
Form 298–C financial data are as
follows:
Mail Rates
The Department of Transportation
sets and updates the Intra-Alaska Bush
mail rates based on carrier aircraft
operating expense, traffic, and
operational data. Form 298–C cost data,
especially fuel costs, terminal expenses,
and line haul expenses are used in
arriving at rate levels. DOT revises the
established rates based on the
percentage of unit cost changes in the
carriers’ operations. These updating
procedures have resulted in the carriers
receiving rates of compensation that
more closely parallel their costs of
providing mail service and contribute to
the carriers’ economic well-being.
Essential Air Service
DOT often has to select a carrier to
provide a community’s essential air
service. The selection criteria include
historic presence in the community,
reliability of service, financial stability,
and cost structure of the air carrier.
Carrier Fitness
Fitness determinations are made for
both new entrants and established U.S.
domestic carriers proposing a
substantial change in operations. A
portion of these applications consists of
an operating plan for the first year (14
CFR part 204) and an associated
projection of revenues and expenses.
The carrier’s operating costs, included
in these projections, are compared
against the cost data in Form 298–C for
a carrier or carriers with the same
aircraft type and similar operating
characteristics. Such a review validates
the reasonableness of the carrier’s
operating plan.
The quarterly financial submissions
by commuter and small certificated air
carriers are used in determining each
carrier’s continuing fitness to operate.
Section 41738 of Title 49 of the United
States Code requires DOT to find all
commuter and small certificated air
carriers fit, willing, and able to conduct
passenger service as a prerequisite to
providing such service to an eligible
essential air service point. In making a
fitness determination, DOT reviews
three areas of a carrier’s operation: (1)
The qualifications of its management
team, (2) its disposition to comply with
laws and regulations, and (3) its
financial posture. DOT must determine
whether or not a carrier has sufficient
financial resources to conduct its
operations without imposing undue risk
on the traveling public. Moreover, once
a carrier begins conducting flight
operations, DOT is required to monitor
its continuing fitness.
Senior DOT officials must be kept
fully informed and advised of all
current and developing economic issues
affecting the airline industry. In
preparing financial condition reports or
status reports on a particular airline,
financial and traffic data are analyzed.
Briefing papers prepared for senior DOT
officials may use the same information.
The Confidential Information
Protection and Statistical Efficiency Act
of 2002 (44 U.S.C. 3501 note), requires
a statistical agency to clearly identify
information it collects for non-statistical
purposes. BTS hereby notifies the
respondents and the public that BTS
uses the information it collects under
this OMB approval for non-statistical
purposes including, but not limited to,
publication of both Respondent’s
identity and its data, submission of the
information to agencies outside BTS for
review, analysis and possible use in
regulatory and other administrative
matters.
