AGENCY: Federal Communications Commission.

ACTION: Proposed rule.

SUMMARY: The Commission requests comments on a petition filedby Vermont ETV, Inc., licensee of noncommercial educational station WVER(TV), NTSC channel \*\28, Rutland, Vermont, requesting the substitution of DTV channel \*\9 for station WVER(TV)'s assigned DTV channel \*\56. DTV Channel \*\9 can be allotted to Rutland, Vermont, in compliance with the principle community coverage requirements of Section 73.625(a) at reference coordinates (43-39-32 N. and 73-06-25 W.). However, since the community of Rutland is located 400 kilometers from the U.S.-Canadian border, concurrence from the Canadian must be obtained for this allotment. As requested, we propose to allot DTV Channel \*\9 to Rutland with a power of 30 and a height above average terrain (HAAT) of 411 meters.
