AGENCY: Federal Communications Commission.

ACTION: Proposed rule.

SUMMARY: The Commission requests comments on a petition filedby WRNN- TV Associates Limited Partnership, licensee of station WRNN-TV, NTSC Channel 62, Kingston, New York, requesting the substitution of DTV Channel 48 for its assigned DTV Channel 21. DTV Channel 48 can be allotted to Kingston, New York, in compliance with the principle community coverage requirements of Section 73.625(a) at reference coordinates (41-29-19 N. and 73-56-52 W). As requested, we propose to allot DTV Channel 48 to Kingston with a power of 200 and a height above average terrain (HAAT) of 388 meters. However, since the community of Kingston is located within 400 kilometers of the U.S.-Canadian border, concurrence by the Canadian government must be obtained for this allotment.

Provisions of the Regulatory Flexibility Act of 1980 do not apply to this proceeding.
