Any department, agency, or instrumentality of the federal government taking an action subject to 20.11.4 NMAC must make its own conformity determination consistent with the requirements of 20.11.4 NMAC. In making its conformity determination, a federal agency must follow the requirements in Sections 14 through 19 and 21 through 24 of 20.11.4 NMAC and must consider comments from any interested parties.
