A. Mandatory inspections: Any person who owns a motor vehicle subject to 20.11.100 NMAC and fails to demonstrate compliance with 20.11.100 NMAC shall be issued a failing VIR and shall be refused re-registration by the MVD pursuant to the Motor Vehicle Code, 66Registration if vehicle emission inspection test required; requiring a certificate; registration in Class A counties66-3-7.1 NMSA (1978).

B. Procedural provisions: Any person who violates the requirements of 20.11.100 NMAC shall be guilty of a misdemeanor pursuant to either the City of Albuquerque Joint Air Quality Control Board Ordinance 9Short title9-15-1 -99(B)(1) R.O.1994 or the Bernalillo County Joint Air Quality Control Board Ordinance No. 94-5. Any person who violates a requirement of 20.11.100 NMAC shall also be subject to all other enforcement actions authorized by the Air Quality Control Act, 74Short title74-2-1 et. seq., NMSA 1978 and other remedies available at law or equity.
