AGENCY: Federal Communications Commission.

ACTION: Proposed rule.

SUMMARY: This document proposes three allotments in Nantucket, MA, Cameron, AZ, and Ferrysburg, MI. The Commission requests comment on a petition filedby John Garabedian proposing the allotment of Channel 254B1 at Nantucket, Massachusetts, as potentially the community's fourth local FM broadcast service commercial FM service. Channel 254B1 can be allotted to Nantucket in compliance with the Commission's minimum distance separation requirements with no site restriction at center city reference coordinates of 41-16-54 North Latitude and 70-06- 06 West Longitude. See SUPPLEMENTARY INFORMATION infra.

SUPPLEMENTARY INFORMATION: This is a synopsis of the Commission's Notice of Proposed Rule Making, MB Docket Nos 02-72, 02-73, 02-74; adopted March 25, 2002 and released March 29, 2002. The Commission further requests comment on a petition filedby McCody Broadcasting Group, Inc. proposing the allotment of Channel 246A at Cameron, Arizona, as the community's first aural broadcast service. Channel 246A can be allotted to Cameron in compliance with the Commission's minimum distance separation requirements with no site restriction at center city reference coordinates of 35-52-30 North Latitude and 111-24-48 West Longitude.

The Commission further requests comment on a petition filedby Northern Paul Bunyan Radio Company proposing the allotment of Channel 226A at Ferrysburg, Michigan, as the community's first local broadcast service. Channel 226A can be allotted to Ferrysburg in compliance with the Commission's minimum distance separation requirements with a site restriction of 2.7 km (1.7 miles) northeast of Ferrysburg. The coordinates for Channel 226A at Ferrysburg are 43-06-04 North Latitude and 86-11-29 West Longitude. The proposed allotment will require concurrence by Canada because it is located within 320 kilometers (199 miles) of the Canadian border.

The Provisions of the Regulatory Flexibility Act of 1980 do not apply to this proceeding. Members of the public should note that from the time a Notice of Proposed Rule Making is issued until the matter is no longer subject to Commission consideration or court review, all ex parte contacts are prohibited in Commission proceedings, such as this one, which involve channel allotments. See 47 CFR 1.1204(b) for rules governing permissible ex parte contacts.
