Fredonia Valley Railroad, Inc.--Acquisition and Operation Exemption--in Caldwell County, KY

Fredonia Valley Railroad, Inc. (FVRR), a noncarrier, has fileda notice of exemption under 49 CFR 1150.31 to acquire and operate approximately 9.65 miles of rail line owned by Martin Marietta Materials, Inc., between milepost 87.60 near Fredonia and milepost 97.25 near Princeton in Caldwell County, KY.‹SUP›1‹/SUP›

\1\ The line to be acquired is a segment of a railroad line authorized for abandonment in Western Kentucky Railway, L.L.C.-- Abandonment--Between Blackford and Princeton, KY, STB Docket No. AB- 449 (Sub-No. 2) (STB served June 21, 1996).

FVRR certifies that its annual revenues will not exceed those that would qualify it as a Class III rail carrier and its revenues are not projected to exceed $5 million.

The transaction was scheduled to be consummated on or after the December 17, 1998 effective date of the exemption.

If the notice contains false or misleading information, the exemption is void ab initio. Petitions to revoke the exemption under 49 U.S.C. 10502(d) may be filedat any time. The filing of a petition to revoke will not automatically stay the transaction.

An original and 10 copies of all pleadings, referring to STB Finance Docket No. 33695, must be filedwith the Surface Transportation Board, Office of the Secretary, Case Control Unit, 1925 K Street, N.W., Washington, DC 20423-0001. In addition, one copy of each pleading must be served on Fritz R. Kahn, P.C., Suite 750 West, 1100 New York Avenue, N.W., Washington, DC 20005-3934.
